The enormous financial cost of criminal justice has motivated increased examination and acknowledgment of the need for constructive modification, but what of the ethical costs of current practices and policies? Part II takes a look at criminalization and criminal liability, and the presumptions and attitudes forming those elements of contemporary criminal justice. Part III evaluates present policies and practices of criminal treatment, exploring the functions of authorities, prosecutors, judges, and juries and recommending instructions for modifying how criminal justice is achieved.
